6-year-old girl imprisoned poor uncle

In Moradabad, a 6-year-old girl has given life imprisonment to her uncle for raping her. About 4 years ago, the 32-year-old uncle took him home on the pretext of giving him a toffee. Where he locked her in the room and raped her. When the blood-soaked girl went home and told the incident to her mother, the mother lodged an FIR against the accused. But after the relatives’ panchayat, the girl’s parents turned hostile to testify in the court.

The girl was also persuaded not to say anything. After all the witnesses were hosted, the judge decided to call the girl again to the court. This time the girl narrated the entire incident to the court.

The incident happened in Katghar in 2017

ADGC Mohammad Akram Khan told that the incident took place on 22 March 2017 in a locality of Katghar police station area of ​​Moradabad. Originally from a village in Bareilly, two real brothers started living in this locality of Moradabad. Both used to run their families by working in factories. The accused uncle reached the elder brother’s house when the parents of the girl were not present at around 12 noon on the day of the incident. He lured his 6-year-old niece to get a toffee and took it to his house in the neighbourhood. His wife was also not at home at that time. Where the poor man locked the niece in the room and tortured her.

One by one all the witnesses turned hostile.

ADGC Akram Khan told that the matter was heard in the court of Special Judge POCSO Act-3 Subhash Singh. But during the trial, one by one all the witnesses turned hostile. The mother of the girl who lodged the FIR also refused to testify in the court. His father and other witnesses also became hostile in the court. While the medical report of the girl was witnessing screaming of the misery that had happened to her. On the persuasion of the family members, the victim of the torture did not even testify against the uncle in the court.

Before the verdict, the court called the girl again

Additional government advocate Akram Khan, who appeared in the case, says that the medical report was confirming the incident. The witnesses testified openly in the investigation. But in the court one after the other, all the witnesses said that the police did not talk to them and have written their statements of their own free will. Her uncle, who abused the girl, also said that she had a dispute over the distribution of land with her brother and that is why the sister-in-law had written a false report.

In these circumstances, the ADGC filed an application in the court requesting that the girl be called once again in the court before the verdict is pronounced. The defense opposed it, but the judge allowed it.

The girl said – uncle did the wrong thing by taking him home

ADCG says that when called again, the girl did not become hostile as before. He took the name of his uncle and said that uncle had taken him home on the pretext of toffee. After this he did the wrong thing by locking him in the room. Along with narrating the entire incident to the court, the girl also explained why she had not been able to tell the truth earlier.

High Court had said – will not give bail

The poor uncle is in jail since the incident. However, the victim and the accused are real uncles and nieces. Therefore, the relatives sat together and made a compromise between the two after a few days of the incident. After the witnesses were hosted in the court, the poor uncle had applied for the court in the High Court. But the High Court had rejected his bail application saying that the case is of rape of an innocent girl. In this case, bail cannot be granted. The High Court had ordered the trial court to hear the matter and decide on it soon.

Life imprisonment and fine of one lakh rupees

After the child’s testimony, Special Judge POCSO Act-3 Subhash Singh found the accused guilty on Tuesday. He has sentenced the victim’s poor uncle to life imprisonment and a fine of one lakh rupees. At the time of the court, he was brought from jail and appeared in the court.
