Case of hiding criminal record in nomination: Samalkha court summons municipal chairman Ashok Kuchhal, DC and SDM

In the Samalkha Municipality elections of Panipat district of Haryana, the troubles of the newly elected chairman Ashok Kuchhal are increasing continuously. Samalkha Court has summoned Chairman Ashok Kuchhal, District Election Officer and DC and Election Officer and SDM Samalkha on July 2 by issuing notices.

RTI activist PP Kapoor filed an election petition in the Election Authority and Samalkha Court alleging that the newly elected Municipality President Ashok Kuchhal was arrested red-handed on November 6, 2017 while taking a ransom of Rs 20 lakh in the case of Jismfiroshi. Chargesheets were also filed from the court on July 6, 2018 in this heinous crime.

Kuchhal had come out on bail from the High Court after being imprisoned for about a quarter of a year after his arrest, but in the nomination papers and affidavits in the Samalkha Municipality elections, Kuchhal hid this criminal record. According to sub-rule 1 (e) of Rule 13A of Haryana Municipal Rules, 1973, a person accused of serious offenses punishable with imprisonment for 10 years or more than 10 years cannot contest for the post of head or member of the municipality.

Demand from court in election petition

In the election petition of RTI activist PP Kapoor, there is a demand from the court that Ashok Kuchhal should be stopped from being sworn in as the chairman of the municipality. Under sub-rule 1(e) of Rule 13A of the Municipal Election Rules, 1973, Kuchhal should be disqualified by canceling the election. It should not be given any charge or responsibility of the Municipal President.
