Government can remove Mayor Soumya Gurjar from office: Supreme Court frees government to act

Mayor of Jaipur Municipal Corporation Greater Dr. Soumya Gurjar has got a big setback from the Supreme Court today. Considering the judicial inquiry report presented by the Supreme Court on behalf of the state government as correct, the court has freed the government to take action. However, the court has directed to take action only after 2 days i.e. after 25 September. After this decision of the Supreme Court, it is now likely that after receiving the return copy of the court’s orders on September 26, the government can sack Soumya Gurjar at any time. In the hearing held in the Supreme Court today, Justice Ajay Oak and Justice Sanjay Kishan Kaul pronounced these orders.

In the Supreme Court, on behalf of the state government, Additional Advocate General (AAG) Manish Singhvi said that after the hearing, the court has directed that the government should take action as per rules after the report of the judicial inquiry. The court told the government – they should not take any action in this matter for 2 days.

Senior Advocate Ruchi Kohli appeared on behalf of Mayor Soumya Gurjar. Let us tell you that the report of the judicial inquiry started in June 2021 against Mayor Soumya Gurjar and other three councilors was presented to the government on August 10 last month, in which three other councilors including Soumya were found guilty. This report was presented by the government in the Supreme Court and demanded a hearing on the matter at the earliest.

Government can sack the post
After getting directions from the Supreme Court, the government can now issue orders to sack Mayor Soumya Gurjar on the basis of the report of the judicial inquiry. The government had earlier sacked three other councilors from the post on August 22 itself. BJP councilor Paras Jain from Ward 72, Ajay Singh from Ward 39 and Independent Shankar Sharma from Ward 103 have abolished membership. These councilors have also been removed by the government on the basis of this judicial inquiry.
