The Gauhati High Court has ordered the Assam government to resettle 100 families evicted during an operation at Gorukhuti in Dhalpur. The order came on a petition filed by Leader of the Opposition in Assam Debabrata Saikia. He was evicted in 2021 after a violent incident. In the violent incident, two people including a boy were killed in police firing.

In September 2021, 100 families of Gorukhuti were evicted by the Darrang district administration in Assam. Around 700 families were evicted during a massive drive by the Assam administration against “illegal encroachers”. Meanwhile, the Assam government has reportedly already rehabilitated 600 displaced families.

Now the Gauhati High Court has asked the Assam government to resettle the remaining 100 families. According to reports, on September 20 and 23, 2021, around 1200 to 1400 houses were demolished in Darpur I, II and III villages of Gorukhuti in Assam, leaving more than 7000 people homeless. Two people were killed in police firing on 23 September 2021 after stiff resistance from the local people. More than 20 people including policemen were injured.

The court said, “After hearing the counsel for the parties, it is clear that around 700 families were evicted from their respective lands. A cabinet decision to set up agricultural farms in respect of the lands which were evicted also Is.” The Court said, “After perusal of the PIL (Public Interest Litigation) as well as hearing the counsel for the petitioner, no material or any ground can be pointed out from which the Court can come to any such conclusion and interfere with the decision of the Cabinet.” .” The High Court said that the Assam government should establish an agricultural farm / model project in Sipajhar.

The court said, “In the information provided by the departmental officers, it has been told that in between about 600 families have been rehabilitated by giving alternative plots of land. Remaining about 100 families have not been provided adequate rehabilitation.” The High Court said, “Since 600 families out of about 700 evicted families have already been rehabilitated, we are of the view that in this PIL, there is no need for the views of anyone other than those remaining about 100 families. “

“We also provide that in the event of any such application being made, the Deputy Commissioner shall pass individual reasoned orders within a period of six months from the date of receipt of such applications from the individual applicants,” the court said.
