In this case, the man had married the second woman despite being the first wife and according to the lawyer, the three have entered into a consensual agreement despite the second marriage without divorce from the first wife being illegal under Hindu law.

Advocate Harish Dewan has termed this ‘agreement’ illegal under the Hindu Marriage Act. According to the lawyer, he has also given separate flats to both the women and has also decided to share his salary in half with both the women. The case pertains to Gwalior in Madhya Pradesh, where the matter came to the fore in the family court.

Dewan said that a girl from Gwalior was married to an engineer working in Gurugram in the year 2018 and both lived together for two years. He said that during the Corona epidemic, the engineer left his wife at her maternal home in Gwalior. Dewan told that in Gurugram he remarried another girl who worked with him in 2020 and had a daughter.

He said that in the meantime, when he did not come to pick up the wife living in Gwalior, she got a little suspicious and one day she reached the husband’s office in Gurugram. There it came to know that her husband had remarried. According to Diwan, there was a lot of controversy over this and in the end the woman filed a case of maintenance in the family court of Gwalior.

Diwan told that after this the husband came to Gwalior, but was not ready to leave the second wife. He said that counseling was also done for both the wives and the husband, but there was no result. “In the end, both the women reconciled with their husbands. In the agreement, they decided that the husband would stay with one wife for three days and the other for three days. On Sunday, it will be the choice of the husband with whom he wants to stay.

Diwan said, “After this agreement, the first wife has gone to Gurugram. There he has given separate flats to both the wives and has also decided to give half of his salary.

When Diwan was asked whether this agreement has legal validity, he said, “This agreement has been made by mutual consent of the three people. There is neither the role of the family court nor that of the counselor in this. Rather, they were explained that they were Hindus and that the agreement was illegal according to Hindu law, as the second marriage was not valid unless the first wife was divorced. But they have made a pact among themselves.
