Yogi government is conducting a survey of Waqf Board properties: there are 1.22 lakh properties in UP; Opposition’s allegation – the intention of the government is not right

After madrasas, now the waqf properties are being surveyed. UP has the highest number of 1.22 lakh properties. It also includes Raj Bhavan in Lucknow, Gyanvapi Masjid in Varanasi and Shahi Masjid of Mathura. According to the Waqf Board, it is not yet possible to estimate the value of these properties. On the other hand, the opposition alleges that the UP government is conducting a survey to use these properties.

NOC is required to sell Waqf Board land. NOC was taken in such purchase and sale. In the last 3 years, the Waqf Board had prepared reports of about 150 such cases and sent them to the government. After this, the Yogi government is conducting a survey of these waqf properties.

On the other hand, politics has also started on the survey of waqf properties. The opposition is raising questions on this. So many Muslim religious leaders have come out in support of it. Many Muslim party leaders are speaking against it.

Before proceeding further in the news, know what is Waqf Board…

Any property can be declared as Waqf
From the legal point of view, if a person donates his movable or immovable property for the purpose of using it in the holy works of Islam, then it is called Waqf. Waqf can be created through deed. Any property can be declared a waqf. If, it is being used for a long time for religious activities related to Islam or for charitable reasons.

Waqf property is used to run religious schools, to build cemeteries, to build mosques or to build shelter homes. If, a person builds a Waqf, then he cannot take back his property from him. A non-Muslim can also build a Waqf. But, he should have faith in Islam.

Waqf works as per Act
Waqf Act 1995 has been enacted. Waqf works according to this Act. According to this Act, a survey commissioner inspects the property of the waqf. For this he investigates, meets witnesses, scrutinizes property documents. The person who manages the Waqf is called Mutawali. Waqf works under his supervision. Waqf also works more or less like a trust.

The trust works under the Indian Trust Act 1882. However, the scope of the trust is much larger. It is not limited to religious functions only. Whereas the scope of Waqf is limited to religious functions only. The trust can be dissolved by its board if it wants, but it is not so with the Waqf.

What is Waqf Board?
The Waqf Board has the power to acquire, retain or transfer property. This is a board made within the purview of the judicial system, so it can prosecute any person. May face trial in court. Every state has its own Waqf Board. It has a chairman. It consists of one or two state government nominees. Who can be Muslim MLA or MP. Then a Muslim scholar can be a member of the State Bar Council.

Order issued in Congress government canceled in Yogi government
An order was issued by the Congress government on 7 April 1989. It said that if common property barren, Bhita, Usar etc. land is being used as Waqf (eg graveyard, mosque, Idgah) then it should be registered as Waqf property only. After that it should be demarcated. Under this order, lakhs of hectares of barren, Bhita and Usar land in the state were registered as Waqf property.

Now this order has been canceled by the government. Last month, Sudhir Garg, the principal secretary of the Revenue Council, issued a mandate and instructed to correct the documents by abolishing the order issued during the Congress regime.

AIMIM said- Survey of temple, monastery should also be done
AIMIM spokesperson Syed Naseem Waqar said that it is a fact that Muslims are being harassed. This is a unilateral action. The government wants to take all this under its own hands and use them. That’s why a survey has been ordered. If the survey is to be done, then all the temples, monasteries and other religious places should also be surveyed.

Earlier, SP President Akhilesh Yadav said that the government is misleading the issue by getting the Waqf Board investigated, we are against the survey, the survey should not be done. On the other hand, senior journalist Hussain Afsar said that after the cancellation of the 33-year-old order of 1989, the Waqf Board can no longer use the land. Only the government can authorize those lands.

Lekhpal and SDM will prepare survey report
DM and Commissioner have been given the responsibility of this survey. The matter related to property is related to the revenue department. Responsibility has been entrusted to SDM and Lekhpal. In this, the Lekhpal will send the details of the land of his respective area to the SDM. Send the SDM to the DM and the DM will send the report to the government through the commissioner’s office. If the property is occupied or encroached upon and constructed on it, how will it be removed. This will also be part of the report.

Gyanvapi Masjid Sunni Waqf Board, Governor Bangla Shia Waqf Property
Central Waqf Board Chairman Ali Zaidi told that Gyanvapi Masjid of Varanasi in UP is the property of Sunni Waqf Board. The Shahi Idgah Masjid of Mathura is registered with the Sunni Waqf Board. Governor’s Bangla is in Shia Waqf. Vikas Deep Building is in Waqf Board. He said that the data of purchase and sale of properties and possession will be ready. The board is going to get the benefit of this.
